
A lawsuit against Dr Margaret Hamburg and others has been filed with the court of the District of Columbia. Dr Hamburg, who was FDA’s commissioner from 2009 to 2015, has been accused of helping suppress information about Levaquin’s side effects, which include death. The news, together with subsequent law suits, would have damaged the profits of Johnson & Johnson, the drug’s manufacturer, in which the hedge fund of Peter Brown, Dr Hamburg’s husband, held significant shareholdings, the suit argues.
The hedge fund, Renaissance Technologies, is estimated to have benefited by as much as half-a-billion dollars from a buoyant Johnson & Johnson share price, the lawsuit claims.
The suit has been filed by attorney Larry Klayman on behalf of plaintiffs claiming serious harm from taking the drug. Critics say that Mr Klayman’s action is politically motivated. A staunch Republican, Mr Klayman has waged legal war against the Obama administration, and Dr Hamburg was appointed to the FDA by the President.
